FTC and States Sue Hims & Hers Over Privacy and Billing Practices

The Federal Trade Commission (FTC), joined by authorities in Utah and California, sued Hims & Hers Health, Inc alleging that the telehealth provider used deceptive billing and subscription practices and improperly disclosed consumers’ sensitive health information to advertising platforms.

According to the federal complaint, Hims & Hers told consumers they could consult with a medical provider to determine whether prescription treatment was appropriate. The FTC alleges that most consumers were instead charged and enrolled in recurring prescription subscriptions shortly after submitting an intake form, without an opportunity to review or approve the treatment.

The complaint also alleges that the company did not clearly disclose monthly prescription-refill dates and created obstacles for consumers seeking to cancel subscriptions. Before 2023, most consumers could cancel only by contacting customer service, according to the FTC. Although online cancellation later became available to most consumers, the agency alleges that the cancellation button remained difficult to find and required navigating several steps.

The FTC further alleges that Hims & Hers shared sensitive health information with Meta, the technology company that owns Facebook and Instagram, Snap, the company that owns Snapchat, and other third parties despite representations that it would protect consumers’ privacy. According to the complaint, Hims & Hers shared customer lists and used tracking technologies that automatically transmitted information about actions taken by visitors on its website.

The plaintiffs allege violations of the FTC Act, the Restore Online Shoppers’ Confidence Act, the Utah Consumer Sales Practices Act, and California’s False Advertising and Unfair Competition Laws. The complaint was filed in the US District Court for the Northern District of California after a 2-0 FTC vote authorizing the action. The allegations have not been adjudicated, and the FTC noted that the case will be decided by the court.
