1. Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the website, newsletter, and related services operated by Medical News Stream LLC (referred to "Medical News Stream," "we," "us," or "our," “Site”, or “Newsletter”) at MedicalNewsStream.com and any successor domain, app or Newsletter (collectively, the "Service"). By accessing or using the Service, or by registering for an account, you agree to be bound by these Terms. These Terms govern your use of the Services and create a binding legal agreement. If you do not agree, do not use the Service.
2. Description of the Service
Medical News Stream publishes original medical, clinical, and healthcare industry content, as well as news summaries drawn from public and licensed third-party sources including government agencies, wire services, medical journals and other sources. The Service is provided free of charge and is supported by advertising. 
3. Eligibility and Intended Audience
The Service is intended only for healthcare professionals, and the content is written with that audience in mind. You do not need to register or log in to read content on the Service — it is publicly accessible. Registration is required only to receive the daily newsletter (see Section 7). By using the Service, you represent and warrant that you have the right, authority, and capacity to agree to and abide by these Terms and that you are not prohibited from using the Services or any portion thereof. 
The Service is not directed to children, and it is not intended for use by anyone under the age of 13. By using the Service, you represent that you are at least 13 years old.
4. No Medical Advice — Disclaimer
The Service does not provide medical advice, diagnosis, or treatment, and nothing on the Service should be relied upon as such. Content is intended for general news and information purposes for a professional healthcare audience only, not as a substitute for the original source material, independent clinical judgment, or consultation with qualified professionals. They are not medical advice, diagnosis, treatment, prescribing guidance, professional consultation, or a substitute for the independent clinical judgment of a qualified healthcare professional. Healthcare professionals remain solely responsible for verifying information against original sources, current prescribing information, product labeling, clinical guidelines, applicable law, institutional policy, and accepted standards of professional practice before making clinical or operational decisions. Medical and scientific information changes rapidly, may be incomplete, and may not reflect the most recent evidence, warnings, approvals, recalls, corrections, or regulatory actions.
Consumers and patients should not use the Services to self-diagnose, select or discontinue treatment, or delay seeking care. They should consult an appropriately qualified healthcare professional about any medical condition, medication, procedure, or treatment. In a medical emergency, call 911 or the applicable local emergency number immediately.
Medical News Stream does not recommend or endorse any particular test, drug, biologic, device, product, therapy, healthcare professional, facility, service, company, opinion, or course of treatment merely because it is discussed, linked, reviewed, advertised, or otherwise presented through the Services
5. Editorial Policy
We identify topics for our news content based on current clinical and professional information needs of physicians and other healthcare professionals. This content is produced by a team of healthcare professions, experienced medical journalists and editors. AI and other tools are used to deliver efficiencies and deliver news in a more timely fashion. All content, regardless of the use of AI or not, undergoes several rounds of human vetting and fact-checking by experienced healthcare professionals before it is published. Despite this review process, we do not warrant that any information is complete, current, or free of error. Medical and scientific information changes quickly, and summarization inherently involves omission of detail present in the original source. You should not make clinical, business, or other decisions based solely on information published on the Service.
6. Intellectual Property and Third-Party Content
Our content. The Service, including all information, content or summaries, as well its design, original commentary, trademarks (including "Medical News Stream"), is owned by Medical News Stream LLC or its licensors and is protected by copyright and other intellectual property laws. Except as permitted by these Terms or applicable law, you may not copy, reproduce, republish, distribute, or create derivative works from the Service without our prior written consent.
Images. Images used on the Service are used under license or other lawful basis and are credited to their licensor (e.g., Getty Images) as required by the applicable license terms.
Licensed third-party content. We license content from  third-party content providers to supplement our own news content. Any such licensed content will be identified as such and is subject to the terms of the applicable license in addition to these Terms.
7. Registration and Accounts
Reading content on the Service does not require an account. If you register — including to receive our daily newsletter — you will create a persistent account using the information requested on our registration form (which includes your name, email address, professional information such as profession, specialty, and NPI number, and other fields as updated from time to time).
You agree to provide accurate information and to keep your password confidential. You are responsible for all activity under your account. We may suspend or terminate an account that we reasonably believe was created with false information or is being used in violation of these Terms.
8. Newsletter and Marketing Communications
Newsletter enrollment is opt-in; the enrollment checkbox on our registration form is not pre-checked, and checking it is never required to complete registration or to use the Service. Every newsletter email includes an unsubscribe mechanism. When you unsubscribe or otherwise opt out, we suppress your contact information from future newsletter and marketing communications.
We may also send introductory marketing communications inviting registration using contact information obtained from licensed third-party data providers whose lists are represented to us as opt-in for third-party marketing use. You may opt out of such communications at any time using the unsubscribe mechanism provided; doing so will not affect your ability to visit the Service directly.
9. Advertising
The Service is supported by advertising, including display, banner, and native advertising served by third-party advertising partners. Some advertising on the Service uses technology that identifies visitors as healthcare professionals through third-party services, as described in our Privacy Policy and Cookie Policy. Advertisements are the sole responsibility of the advertiser; we do not endorse, and are not responsible for, any product, service, or claim made in an advertisement appearing on the Service.
10. Future Subscription Services
We currently offer the Service free of charge, supported by advertising. We may in the future introduce paid subscription tiers, premium content, or a mobile application with paid features. If and when we do, additional terms specific to that offering (including pricing, billing, and cancellation terms) will apply and will supplement, not replace, these Terms. Continued use of any free portion of the Service will remain governed by these Terms.
11. International Use
The Service is directed at healthcare professionals and other readers in the United States. We do not market to, or intend to monetize traffic from, users located outside the United States, but the Service is not geographically restricted and may be incidentally accessed from other countries. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. We make no representation that the Service is appropriate, or available for use, outside the United States.
12. Prohibited Conduct
You agree not to: (a) provide false information when registering; (b) scrape, harvest, or systematically extract content from the Service other than through standard browsing or permitted syndication; (c) use the Service to transmit unlawful, infringing, or harmful content; (d) interfere with the security or normal operation of the Service; or (e) use the Service in any way that violates applicable law.
13. Third-Party Links
The Service links to third-party websites, including original news sources, journals, and agency statements. We do not control and are not responsible for the content, accuracy, or privacy practices of any linked third-party site. Your use of any linked site is at your own risk and subject to that site's own terms.
14. Disclaimer of Warranties
THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR AVAILABILITY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
15. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MEDICAL NEWS STREAM LLC AND ITS OWNERS, OFFICERS, AND CONTRIBUTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON ANY CONTENT — INCLUDING ANY ERROR OR OMISSION IN AI-ASSISTED CONTENT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED ONE HUNDRED DOLLARS ($100).
Some jurisdictions do not allow certain limitations on liability, so some of the above limitations may not apply to you.
16. Indemnification
You agree to indemnify and hold harmless Medical News Stream LLC and its owners, officers, and contributors from any claim, loss, or expense (including reasonable attorneys' fees) arising from your violation of these Terms or your misuse of the Service.
17. Term, Suspension, and Termination
We may suspend or terminate your access to the Service, or any account, at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may stop using the Service, or request deletion of your account, at any time by contacting us as described in Section 21.
18. Changes to These Terms
We may update these Terms from time to time. We will post the revised Terms with an updated "Last Revised" date. Continued use of the Service after a revision takes effect constitutes acceptance of the revised Terms.
19. Governing Law and Disputes
These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey, and you consent to personal jurisdiction there.
20. General Provisions
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect. Our failure to enforce any provision is not a waiver of that provision. These Terms constitute the entire agreement between you and Medical News Stream LLC regarding the Service, superseding any prior agreements on the same subject.
